Certain editions of BDS software may provide optional features that allow the application to communicate with BDS-operated supporting services, locally hosted supporting services, or authorized third-party services.
These services collectively constitute the Ecosystem. Ecosystem functionality is optional and user-controlled.
Ecosystem features are not enabled by default unless explicitly stated.
By activating ecosystem features, you consent to the application communicating with configured services as required to perform selected functions.
You may disable ecosystem features at any time through available settings, subject to feature limitations.
Unless explicitly stated in product documentation, you retain ownership of all content processed through ecosystem features, BDS does not claim ownership of your content, and BDS does not automatically publish, distribute, or commercialize your content.
If ecosystem features involve data transmission, only the data necessary to perform the selected function is transmitted. Transmission occurs in accordance with applicable product documentation and configuration settings.
Local-first operation remains available where supported.
Ecosystem features may depend on infrastructure operated by BDS or third parties.
BDS does not guarantee uninterrupted availability of ecosystem services.
BDS may modify ecosystem features, replace supporting services, or suspend or discontinue ecosystem services. Reasonable notice may be provided where practical.
If you connect the Software to third-party services, you are responsible for complying with their terms of service.
BDS is not responsible for third-party service performance, availability, or data practices.
Use of ecosystem features does not create a custodial relationship unless explicitly stated in separate written terms.
Unless a specific service agreement is executed, BDS does not act as a data processor for your content beyond functional execution of selected features and does not assume archival, backup, or preservation obligations.
You are responsible for securing your local environment, protecting credentials used to access ecosystem services, and managing access to your configured services.
BDS is not responsible for security breaches resulting from compromised user credentials or local system vulnerabilities.
To the maximum extent permitted by law, BDS shall not be liable for indirect, incidental, consequential, or special damages arising from ecosystem service interruptions, third-party failures, or configuration errors.
Total liability relating to ecosystem features shall not exceed the amount paid for the associated software license in the preceding twelve months.
BDS may suspend ecosystem-related access if the user violates applicable agreements, uses the ecosystem for unlawful purposes, or creates identified security risks.
These Ecosystem Terms are governed by the laws of the State of Kentucky, United States.
These Ecosystem Terms supplement the applicable Software EULA.
If there is a conflict between the EULA and these Ecosystem Terms regarding ecosystem features, these Ecosystem Terms control.
